Removing project participants

The Procedures for the withdrawal of project participants after final determination under the verification procecedure under the Joint Implementation Supervisory Committee set out the rules for removing project participants under the Track 2 process after the project has been determined by the accredited independent entity (AIE) and finally determined by the Joint Implementation Supervisory Committee (JISC).

If a project participant wishes to withdraw, this must be notified to the secretariat in accordance with the modalities of communication, together with a statement from the project participant seeking to withdraw:

If, after final determination in accordance with paragraph 35 of the JI guidelines, project participants want to withdraw from a JI project, this information shall be submitted to the secretariat in accordance with the relevant modalities of communication, via email (ji-info@unfccc.int or secretariat@unfccc.int) or fax (+49 228 815 1999), together with corresponding statements of the project participants that wish to withdraw (Procedures for the withdrawal of project participants after final determination under the verification procecedure under the Joint Implementation Supervisory Committee, JISC 9, Annex 3, paragraph 5).

However, if the project participant wishes to withdraw at the time of submission of the verification report, the request may be forwarded to the secretariat by the AIE conducting the verification:

If project participants shall be withdrawn at the time a verification report is submitted to the secretariat by an accredited independent entity (AIE) in accordance with paragraph 38 of the JI guidelines, the information referred to in paragraph 5 above may alternatively be channelled through the AIE (Procedures for the withdrawal of project participants after final determination under the verification procecedure under the Joint Implementation Supervisory Committee, JISC 9, Annex 3, paragraph 6).

While a legal entity authorised by a Party to participate in a JI project may withdraw altogether, a Party involved may only withdraw from its role as a project participant, not from its role as a Party involved (that is, it cannot revoke its letter of approval after final determination):

A legal entity authorized by a Party involved to participate in the JI project may withdraw completely from the JI project, a Party involved in the JI project may only withdraw from its role as a project participant (Procedures for the withdrawal of project participants after final determination under the verification procecedure under the Joint Implementation Supervisory Committee, JISC 9, Annex 3, paragraph 7).

Upon the withdrawal, a new statement of modalities of communication must be submitted, signed by all remaining project participants:

If project participants withdraw, the information submitted in accordance with paragraphs 5 or 6 above shall also contain revised modalities of communication, including contact details1, signed by all remaining project participants( Procedures for the withdrawal of project participants after final determination under the verification procecedure under the Joint Implementation Supervisory Committee, JISC 9, Annex 3, paragraph 8).
