Confidentiality

Any confidential information obtained from project participants must not be disclosed without consent, unless required by law:

Information obtained from project participants marked as proprietary or confidential shall not be disclosed without the written consent of the provider of the information, except as required by applicable national law of the host Party (9/CMP.1, Annex, paragraph 40).

However, information used to determine whether emission reductions are additional, to describe the baseline methodology or to support an environmental impact assessment shall not be considered confidential:

Information used to determine whether reductions in anthropogenic emissions by sources or enhancements of anthropogenic removals by sinks are additional, to describe the baseline methodology and its application, and to support an environmental impact assessment referred to in paragraph 33 (d) above, shall not be considered as proprietary or confidential (9/CMP.1, Annex, paragraph 40).
